Creator Spots Terms of Service

These Terms govern your use of Creator Spots (creatorspots.co.uk) and the services provided through it. By making a booking, listing a venue, or otherwise using the Platform, you agree to these Terms.
If we make material changes to these Terms, we will publish the updated version on this page, update the date above, and notify Venues by email at least 30 days before the changes take effect. Minor changes (such as typo corrections or clarifications that do not affect your rights) may take effect immediately on publication. Continued use of the Platform after changes take effect constitutes acceptance.

1. Nature of the Platform
Creator Spots is an online marketplace that connects independent content creators ("Creators") with independent venue operators ("Venues"). We act as an intermediary only. We are not:

The owner of listed Venues
The employer of any user
Responsible for Venue operations
Responsible for Creator conduct or content
The contract for the use of a space is between the Creator and the Venue. Creator Spots is not a party to that contract.

2. Eligibility and Booking Information
Creator Spots does not require Creators to create an account. To make a booking, you must:

Be at least 18 years old
Provide accurate name, email, phone, and any other information requested at the time of booking
Use the Platform for lawful purposes only
By submitting a booking, you confirm that the information you have provided is accurate and that you meet these requirements.
Venues are listed on behalf of the Venue operator. Venue operators must provide accurate information about their space, availability, pricing, and any house rules.

3. Bookings and Payments
Creators book Venues through the Platform. Venues set their own availability and pricing. All payments are processed through Stripe.
Creator Spots may:

Collect payment from the Creator on behalf of the Venue
Deduct commission from the amount collected
Transfer the remaining funds to the Venue

We act as a limited payment agent for Venues solely for the purpose of processing bookings. Payment is due at the time of booking. Bookings are not confirmed until payment is received.

4. Commission
Creator Spots charges Venues a commission on confirmed bookings. The applicable commission rate is agreed with each Venue at the time of listing. Commission may change from time to time for future bookings, with at least 30 days' notice given to the Venue in advance. Commission is non-refundable once a booking is confirmed, except where required by law.

5. Cancellations and Refunds
The following cancellation policy applies to all bookings on the Platform:

More than 48 hours before the booking start time: full refund of the booking fee
Between 24 and 48 hours before the booking start time: 50% refund of the booking fee
Less than 24 hours before the booking start time: no refund

The commission portion of the booking fee is non-refundable in all cases, as the work of processing the booking has already been completed.
If a Venue cancels a confirmed booking, the Creator receives a full refund including commission, and Creator Spots may apply additional measures to compensate the Creator at our discretion.
Refunds may also be considered in cases of force majeure, as set out in Section 19.
Creator Spots may assist in dispute resolution but is not liable for refund decisions outside this policy.

6. House Rules
Each Venue may publish additional house rules on its listing page. By making a booking, the Creator agrees to comply with both these Terms and the relevant house rules for that Venue. House rules may include but are not limited to:

Which spaces are included in a booking
The types of activity permitted
The number of people allowed on site
Restrictions on equipment, lighting, or props
Any other Venue-specific requirements

Breach of a Venue's house rules is treated as a breach of these Terms and may result in the Creator being refused future bookings on the Platform.

7. User Conduct
Users agree not to:

Damage property
Engage in unlawful filming or recording
Violate copyright, privacy, or data protection laws
Capture or publish content featuring identifiable people without their consent
Circumvent the Platform's payment systems
Harass, threaten, or abuse other users
Use the Platform for adult content, illegal activity, or anything that could reasonably damage the reputation of the Venue or the Platform

We may remove listings and refuse future bookings where these terms are breached.

8. Damage and Loss
The Creator is responsible for any damage caused to the Venue or its contents during a booking, whether caused by the Creator, their crew, talent, or guests. Where damage occurs:

The Venue may invoice the Creator directly for the reasonable cost of repair or replacement
Invoices for damage are payable within 14 days of issue
Creator Spots may assist the Venue in pursuing payment, including by sharing the Creator's contact details with the Venue for this purpose
Creators who fail to pay valid damage invoices will be refused future bookings on the Platform

Creator Spots is not party to the damage claim between the Creator and the Venue and does not guarantee recovery of damages on behalf of the Venue.

9. No-Show and Late Arrival
The booking period is the period agreed at the time of booking. Late arrival does not extend the booking. No-shows are not eligible for a refund. Bookings end at the agreed time regardless of when the Creator arrives or how much of the booking is used.

10. Insurance and Risk
Creators are responsible for:

Their own equipment
Compliance with all relevant filming, recording, and content laws
Securing any permissions required to feature people, brands, or third-party property in their content

Creators are encouraged but not required to hold public liability insurance, except where a specific Venue requires it as part of its house rules.

Venues are responsible for:

Maintaining safe premises
Holding appropriate business insurance for their operations

Creator Spots is not liable for injury, property damage, or other losses arising from bookings.

11. Content and Intellectual Property of Bookings
Photographs, video, and other content captured during a booking remain the property of the Creator unless otherwise agreed in writing with the Venue.
Where a Creator publicly tags @creatorspots on social media in connection with content from a booking, the Creator grants Creator Spots a non-exclusive, royalty-free licence to repost, share, and feature that content on Creator Spots' own social media channels and website, with credit to the Creator. This permission can be withdrawn at any time on written request to hello@creatorspots.co.uk.
Venues may use content of their space only where the Creator has given permission, either in writing or by public tag.
Trial sessions and other promotional arrangements may include separate content licensing terms agreed in writing at the time of booking.

12. Platform Intellectual Property
All Platform content, including branding, design, copy, and software, belongs to Creator Spots. Users may not copy, replicate, or reproduce any part of the Platform without written permission.

13. Disputes Between Users
Disputes between Creators and Venues should first be addressed directly between the parties. Creator Spots may offer mediation assistance at our discretion but is not responsible for the final outcome.

14. Privacy
Personal information collected through the Platform is processed in accordance with our Privacy Policy, available at creatorspots.co.uk/privacy-policy.

15. Limitation of Liability
To the fullest extent permitted by law:

We are not liable for indirect or consequential losses
Our total liability is limited to the commission paid to Creator Spots on the relevant booking

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under English law.

16. Indemnity
Users agree to indemnify and hold Creator Spots harmless against claims arising from:

Breach of these Terms
Misuse of the Platform
Damage caused during bookings
Content captured or published in connection with a booking

17. Refusal of Future Bookings
Creator Spots reserves the right to refuse future bookings from any Creator and to remove any Venue from the Platform where:

These Terms or a Venue's house rules have been breached
Damage invoices remain unpaid
Fraud or attempted fraud is suspected
Platform payment systems have been circumvented
A user has engaged in harassment or abusive behaviour

Where a user is refused future bookings, any pending booking requests will be cancelled and any payments already collected will be refunded in line with the cancellation policy in Section 5. Confirmed bookings already paid for will be honoured where possible.
Venue operators may remove their listing on 30 days' notice, subject to honouring any confirmed bookings during that period.

18. Changes to These Terms
We may update these Terms from time to time. Material changes will be published on this page with the updated date at the top, and Venues will be notified by email at least 30 days before they take effect. Minor changes may take effect immediately on publication.

19. Force Majeure
We are not liable for failure to perform our obligations under these Terms due to events outside our reasonable control, including but not limited to natural disasters, severe weather, fire, flood, strikes, pandemic, epidemic, government restrictions, civil unrest, war, or failures of the internet or third-party services on which the Platform depends.

20. Platform Availability
Creator Spots is provided on an "as available" basis. We do not guarantee uninterrupted access to the Platform. We are not liable for losses arising from Platform downtime, technical faults, or third-party service failures affecting the booking flow.

21. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
